Navistar International Corporation has reached an agreement with the Environmental Protection Agency (EPA) in which EPA promised to hold a public workshop or hearing to address issues Navistar raised in its federal court appeal of EPA’s certification policies for SCR-equipped diesel-powered trucks.

Navistar had asked the US Court of Appeals in Washington DC to void those polices because they had been adopted by the EPA without the public process required by law, but instead following input only from the SCR engine makers. In its appeal, Navistar charged that EPA is using those policies to allow SCR-equipped diesel powered trucks to operate for extended periods without any control of nitrogen oxide (NOx) emissions and is certifying SCR engines as meeting NOx emission requirements when they do not.

The agreement provides that EPA will “engage in a public process to re-examine its policies, for future 2011 and later model year engines” during which it will “provide a thorough review of EPA’s policies regarding operation of SCR-equipped engines.” EPA also has promised to “ensure, among other things, that SCR-equipped heavy-duty diesel engines are designed to properly control emissions as required under applicable regulations.”

The agreement must be published by EPA in the Federal Register for comment before it can become final.

“We are pleased with this agreement and look forward to participating in the public process,” said Jack Allen, president of Navistar’s North American Truck Group. “We believe that with full and open public participation, EPA will develop a new approach that will result in equal enforcement of the 2010 NOx requirements for all engine makers.”

In March, Navistar’s MaxxForce DT mid-range diesel engines and MaxxForce 13 big-bore diesel engines were certified by the EPA for model year 2010.

So you want to know where it all began?  It all started when I began working for Herb in 1999 at Colberg Bros. Custom Automotive.  It was awesome, we were busy, life was good andI was working under the hands of a genius.  I was still a little wet behind the ears, never wrenching as a profession prior to Herbie, but on the road to a world of knowledge.  Herb is known, to all who know me, as my dad.  We hit it off right from the start andran with it.  Not too long after, dad had his 6th heart attack and his health was declining.  Something wasn’t right, he was up and down, everyday was unpredictable.  Time goes by and Herb is diagnosed with renal disease andgoes on dialysis 3 days a week at 5 hours a pop.  That pretty much paralyzed him as a mechanic not being able to turn a wrench.  So he came to me with an option, either he loses the business and I lose my job, or I take it over.  By now I bet you guessed that I took it over.  So, from June 01, 2001 it became Rocco’s Automotive, INC.  and for 6 years it stayed that way.  Herb’s health was getting better and he started wrenching again, andthings were good.  But our business just never seemed to grow enough, come to findout by now it was just the location.  Tucked in the middle of a business park with no exposure to the public we were getting by solely on referrals and repeat customers.  When we saw the lube shop on Santa Fe up for lease, our wheels started turning, thinking what if?  As of April 26, 2006 we became Rocco’s Automotive & FAST LUBE.  Having the exposure of Santa Fe traffic and the general public walking in our door opened up all kinds of possibilities for us.  More and more people were finding out everyday how we operate and conduct our business, and in turn we grew.  3 employees to 7 in 1 year.  Thanks to a great staff who take pride in their work and loyal customers who take pride in their vehicles, our customer base has multiplied by 3 in the 1st year and 4 in the 2nd year.  Join us and help us grow again in our 3rd year.

UAW urges Congress To Let EPA Set New Emissions Rules

Washington — The United Auto Workers union urged Congress on Monday to reject efforts to bar the Obama administration from setting the first-ever limits on tailpipe emissions.

Alan Reuther, the union’s legislative director, said in a letter Monday that efforts by Sen. Lisa Murkowski, R-Ala., and others to bar the Environmental Protection Agency from declaring greenhouse gases a danger to public health were “misguided.”

“The UAW also is deeply concerned that overturning EPA’s endangerment finding would unravel the historic agreement on one national standard for fuel economy and greenhouse gas emissions for light-duty vehicles that was negotiated by the Obama administration last year,” Reuther wrote.

In May 2009, the White House, automakers and 13 states led by California reached a deal to impose joint fuel efficiency standards and tailpipe emissions limits for the 2012-16 model years. The final regulation must be in place by April 1 to take effect starting with the 2012 model year.

“Most importantly, California and other states have agreed to forgo state-level regulation of tailpipe emissions and abide by the new national standard that will be created by these NHTSA and EPA rules. This will avoid the burdens that would have been placed on automakers if they had been forced to comply with a multitude of federal and state standards,” Reuther said.

“These proposed rules will retain the structural components that Congress enacted in the 2007 energy legislation, thereby providing important flexibility to full line manufacturers and a backstop for the domestic car fleet.”

Reuther noted that California could move ahead if the EPA is barred from setting national standards.

“In the absence of the EPA standard, California and other states would certainly move forward with their standards, thereby subjecting auto manufacturers to all of the burdens that the one national standard was designed to avoid,” Reuther said.

Murkowski defended her bill, noting Democrats are working with her.”We do not want EPA imposing economically harmful climate regulations,” she said. “Energy and environmental policies should be developed in Congress, where the best interests of the American people can be represented.”

Robert Dillon, a spokesman for Murkowski, said the Obama administration had created confusion by reversing a Bush administration decision and granting California power to set its own tailpipe emissions standards.

“They’ve created this problem and now they are trying to blame us,” he said.

Alabama, Virginia and Texas, 13 members of Congress and business groups, including the National Association of Manufacturers, have filed suit seeking to block EPA from regulating greenhouse gas emissions.

But Reuther said legislation from Congress on climate change could spur job growth.

“We believe such legislation can help to provide significant investment in domestic production of advanced technology vehicles and their key components, as well as other energy saving technologies,” Reuther said.

Reuther also warned that the National Highway Traffic Safety Administration, which sets corporate average fuel economy requirements, could also be delayed from setting its standards by month’s end if the EPA can’t go forward.

NHTSA plans to set a fleetwide standard of 34.1 mpg by the 2016 model year — a move that boosts fuel efficiency by nearly 40 percent over 2007 levels.

U.S. vehicles account for 23 percent of total U.S. greenhouse gas emissions.

The proposed standards would reduce emissions by nearly 950 million metric tons and conserve 1.8 billion barrels of oil over the lifetime of model year 2012-2016 vehicles, the EPA said.
